Adoption in New Jersey

Understanding In-State adoption (called an intrastate adoption) and Out-of-State Adoption (called an interstate adoption) is important since each type of adoption must meet a different set of legal requirements. An intrastate adoption must meet the requirements of only one state, in your case probably New Jersey.  In an interstate adoption the requirements of at least two states must be met.

Understanding In-State (Intrastate) and Out-of- State (Interstate) Adoption

With an In-state adoption the birth mother and baby live in the same state as the adopting family. In such cases the adoption process, the ending of the birth parents rights, post-placement supervision and the finalization of the adoption are all controlled by the laws of the one state where all parties reside.

If the birth mother and baby reside in a different state from the adoption family (and this the case with many adoptions), then the laws of both states need to be addressed.  Additionally, since the child is taken from one state to another state for the adoption placement, the requirements of the Interstate Compact Act must be met.
